This writ petition is filed challenging the action of the 2nd respondent in not releasing the petitioner's vehicle i.e. Hyundai Verna Car bearing No.TS 08 GA 1411, seized in respect of Crime No.124/2019, dt.22.05.2019, inspite of her readiness to furnish third party surety. Heard learned counsel for the petitioner.
Learned Assistant Government Pleader for Home submits that petitioner's vehicle is involved in Crime No.124/2019, dt.22.05.2019, and as such, she can make necessary application under Section 457 Cr.P.C. It is to be seen that, having seized the vehicle, the respondent police are bound to produce the same before the concerned jurisdictional Magistrate and it is open for the petitioner to submit application before the said Court for release of the vehicle.
In view of the aforesaid facts and circumstances, recording the submission of learned Assistant Government Pleader, the writ petition is disposed of. However, it is open for the petitioner to submit an application for release of her vehicle, before the concerned jurisdictional Court where the vehicle is produced by the respondent police. No order as to costs. As a sequel thereto, miscellaneous petitions, if any, pending in the writ petition, shall stand closed.
