Gurram Vajram v. The District Collector, West Godavari District At Eluru
THE HON'BLE SRI JUSTICE C. PRAVEEN KUMAR WRIT PETITION No.12298 OF 2012 ORDER:
Heard the learned counsel for the petitioners and the learned Government Pleader for Revenue. With the consent of both the parties, the writ petition is disposed of.
The present writ petition came to be filed seeking issuance of writ of Mandamus declaring the action of the respondents in not considering the representation dated 16-03-2012 made by the petitioners for grant of pattadar passbooks to the lands covered by R.S.No.17/1, 2, 3, 4, 5 situated at Palacherla Rajavaram Village, Jeelugumilli Mandal, as illegal and arbitrary. Though various grounds raised in the petition, learned counsel for the petitioners restricts his prayer seeking a direction to the 2nd respondent to pass orders on the representation dated 16-03-2012 made by the petitioners for grant of pattadar passbook and title deed in respect of lands covered by above R.S.numbers.
Though no counter is filed, on oral instructions, learned Government Pleader for Revenue submits that the said representation is still pending and a direction may be given to dispose of the same in accordance with law. Without going into the merits of the case and having regard to the circumstances of the case, the writ petition is disposed of directing the 2nd respondent-Tahsildar to consider the representation dated 16-03-2012 made by the petitioners within a period of (12) weeks from the date of receipt of the order, in accordance with law. As a sequel thereto, Miscellaneous Petitions, if any, pending shall stand closed.
