HONOURABLE JUSTICE G. SRI DEVI I.A.Nos.2 and 3 of 2019 In/and CRIMINAL PETITION No. 4454 of 2019 ORDER:
The petitioners, who are A1 to A7 in C.C.No.326 of 2017 on the file of the XIV Metropolitan Magistrate, Cyberabad L.B. Nagar at Hyderabad, filed this Criminal Petition under Section Cr.P.C.
to quash the proceedings in the above C.C. A charge sheet came to be filed against the petitioners for the offences punishable under Sections 498-A, 324 and 506 IPC and 3 and 4 of D.P. Act.
2. During pendency of the Criminal Petition, I.A.Nos.2 and 3 of 2019 came to be filed by the second respondent to record the compromise and to compound the offences. Along with the petitions, a joint memo came to be filed, inter alia stating that at the intervention of elders and well wishers, the parties have settled their disputes in terms of the compromise. The said joint memo has been supported by the affidavit of the second respondent. The parties also filed agreement of settlement. It is stated in the affidavit that A1 is represented through General Power of Attorney, which is executed by A2 to A7 in favour of A1 and the GPA is placed on record. According to the terms of
compromise, A1 agreed to pay a sum of Rs.8,00,000/- to the 2nd respondent-wife as full and final settlement and the 2nd respondent received Rs.2,00,000/- on 29.07.2019 and remaining balance amount of Rs.6,00,000/- will be paid at the time of withdrawal of cases filed by the respective parties and also after filing of the mutual divorce petition.
3. Today, both the parties are present before this Court and they are identified by their respective counsel. The parties have produced Aadhar Cards and photographs, which show their identity. This Court, when examined, both the parties have stated that at the instance of the elders, they have settled the matter out of the Court and the second respondent has no objection for quashing the proceedings against the petitioner.
4. In the light of the compromise arrived at between the parties, the compromise memo filed by both the parties is recorded and I.A.Nos.2 and 3 of 2019 are ordered.
5. Accordingly, the Criminal Petition is allowed in terms of compromise, and the proceedings in C.C.No.326 of 2017 on the file of the XIV Metropolitan Magistrate, Cyberabad at L.B. Nagar, Hyderabad, against the present petitioners-A1 to A7 are hereby quashed. Both parties are directed to deposit a sum of Rs.5,000/- to the High Court Legal Service Committee, Hyderabad, within a period of one
week from today. Miscellaneous petitions, if any pending shall stand closed.
