THE HON'BLE SRI JUSTICE RAJA ELANGO Criminal Petition No.910 of 2011 ORDER:

This Criminal Petition is filed under Section 482 Cr.P.C seeking to quash the proceedings in Crime No.53 of 2010 on the file of the Kanipakam Police Station, Chittoor District, registered for the offences punishable under Sections 447, 323, 506 read with Section 34 I.P.C. and Section 3(1)(x) of S.Cs. & S.Ts. (PoA) Act, 1989. The learned counsel for the petitioner mainly submitted that it is a case of counterblast and as far as petitioner Nos.1 and 3 are concerned, they also belong to Scheduled Caste, so offence under Section 3(1)(x) of S.Cs. & S.Ts. (PoA) Act, 1989, does not attract and the allegations also false.

This Court is of the view that these are all matters to be investigated by the Investigation Agency. Hence, this Court is of the view that the Criminal Petition can be disposed of with the following directions :

The Respondent-Police are at liberty to proceed with the investigation and file final report, if any, without arresting petitioners. Accordingly, the Criminal Petition is disposed of. Consequently, the Miscellaneous Petitions pending, if any, in this Criminal Petition shall stand closed.
