Heard learned counsel for the petitioner.
In view of the nature of disposal of the writ petition, issuance of notice to respondent Nos.5 to 13 is dispensed with. The petitioner appears to have lodged a complaint before respondent No.2-Collector and District Magistrate, YSR Kadapa District, against respondent Nos.5 to 13 stating that though they belong to Balija Community, they obtained Community Certificates claiming to be Scheduled Tribes (Chenchu community) and joined the services of the Government. The complaint of the petitioner was placed before the District Level Scrutiny Committee and after enquiry, respondent No.2 passed an order, dated 27.04.2012, against respondent Nos.5 to 13 cancelling their community certificates. Against the said order, respondent Nos.5 to 13 preferred appeal before respondent No.
1-Government, which in turn initially suspended the order of respondent No.2 while taking the appeal on file. However, respondent No.1 finally passed an order remanding the matter to respondent No.2, vide G.O.Ms.No.107, Tribal Welfare (CV2) Department, dated 23.12.2015. Challenging the said order of remand, the present writ petition is filed.
as respondent No.2 has to conduct de novo enquiry, as ordered by respondent No.1. He sought fixation of time limit for completion of such enquiry.
In view of the above, respondent No.2 is directed to comply with the order of respondent No.1 passed in G.O.Ms.No.107, dated 23.12.2015, complete the enquiry and pass final orders after giving due opportunity to the petitioner and respondent Nos.5 to 13, within a period of six (6) months from the date of receipt of a copy of this order. It is needless to observe that respondent Nos.5 to 13 shall cooperate with the enquiry.
The writ petition is accordingly disposed of. Miscellaneous petitions, if any, pending in this writ petition shall also stand closed. There shall be no order as to costs. ________________________ A.RAMALINGESWARA RAO,J Dt:08.03.2017 kdl
