HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No.9608 OF 2017 ORDER:

This writ petition is filed questioning the action of the 2nd respondent in not demolishing/removing the encroachments made by the respondents 3 and 4 on the Municipal Road abutting the plot of the petitioner bearing No.6, near H.No.3-3-54, Jambi Hanuman, Armoor, Nizamabad District. Heard the learned counsel for the petitioner and the learned Government Pleader for 1st respondent.

It is the case of the petitioner that the respondents 3 and 4 have occupied the road margin by making illegal constructions over an extent of 29.3 x 18 feet on the main road at Jambi Hanuman, Armoor, Nizamabad, due to which the petitioner is unable to enter into her plot. The petitioner submitted several representations to the 2nd respondent to remove the illegal constructions made by the respondents 3 and 4, but the 2nd respondent did not take any action so far. Ultimately the petitioner got issued a legal notice to the respondents 2 to 4 on 13.08.2016, but the 2nd respondent did not take any steps to consider the legal notice/representation of the petitioner. Hence, the writ petition.

Learned counsel for the petitioner submits that bringing all these aspects to the notice of the respondents 2 to 4, petitioner submitted a legal notice/representation dated 13.08.2016, but the 2 respondent failed to take any action so far.

Inasmuch as the grievance of the petitioner is for consideration and disposal of his representation/legal notice dated 13.08.2016, the writ petition can be disposed of without expressing any opinion directing the 2nd respondent to consider the representation/legal notice dated 13.08.2016 submitted by the petitioner and take action in accordance with law, if there are any violations committed by the respondents 3 and 4, within a period of four weeks from the date of receipt of copy of this order.

With the above observations, the writ petition is disposed of. No order as to costs.

As a sequel to disposal of the writ petition, WP.M.Ps if any pending shall stand disposed of as infructuous.
