HON'BLE SRI JUSTI CE A. RAMALI NGESWARA RAO Writ Petition No. 5286 of 2016 Order:

This Writ Petition was filed challenging the action of the respondents in not completing the investigation in Crime No.83 of 2012 pending on the file of Begumpet Police Station. A counter affidavit was filed on 13.04.2016 stating that the entire investigation was completed and they are waiting for the prosecution orders from the Government to prosecute accused Nos.1 to 6. Now, the learned Government Pleader for Home, on the basis of written instructions, submits that A2 to A6 were arrested on 07.03.2012 and they were remanded to judicial custody and A1 is absconding. A charge sheet was filed before the XI Additional Chief Metropolitan Magistrate, Secunderabad, and the same was taken on file in C.C.No.1896 of 2016.

In the said charge sheet it was specifically mentioned that separate charge sheet will be filed against A1 as soon as he is traced. The accused are facing trial in the said case. In view of the above averments, no further orders are necessary except directing the police to take steps for tracing the accused No.1 and complete the investigation in respect of him as expeditiously as possible. The Writ Petition is, accordingly, disposed of. There shall be no order as to costs.

As a sequel thereto, the miscellaneous petitions, if any, pending in this Writ Petition shall stand closed.
