HONOURABLE SRI JUSTICE A.RAMALINGESWARA RAO WRIT PETITION No.12174 of 2012 ORDER:

1. This writ petition was filed by the petitioner challenging the action of the 2nd respondent in registering the crime in F.I.R.No.21 of 2012 on the file of Nagireddypet Police Station, Nizamabad. 2.

This Court granted interim stay of all further proceedings in Crime No.21 of 2012 by order dated 26.04.2012. 3.

In the counter-affidavit filed by the Sub Inspector of Police, Nagireddypet Police Station, respondent No.2, it is stated that pursuant to the complaint made by the Tahsildar, Nagireddypet Mandal, on 13.03.2012, the crime was registered.

During the course of investigation, the Investigating Officer examined the complainant and recorded his detailed statement. The investigation is pending for want of examination of some more witnesses and at that stage the petitioner approached this Court and filed the present writ petition and that further investigation is stayed.

Learned Counsel for the petitioner submits that the Revenue Divisional Officer submitted a report to the District Collector stating that the petitioner was not involved in any irregularity in discharge of Government duty. However, in view of the registration of the complaint, it is for the Investigating Officer to continue the investigation and take further steps.

In the circumstances, the interim order passed by this Court dated 26.04.2012 is modified by directing the 2nd respondent to continue the investigation and file charge sheet/final report, if any, but the petitioner shall not be arrested pursuant to the investigation till such time.

The Writ Petition is accordingly disposed of. No order as to costs.
