THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 3953 OF 2017 O R D E R :

Seeking to declare the action of the 2nd respondent Vijayawada Municipal Corporation in trying to demolish the asbestos sheet shed in premises bearing D. No. 76-1-1/102/6, Flat No. 102/6, Phase I, Middle Income Housing Scheme, Ground Floor, Bhavanipuram, A.P. Housing Board Colony, Vijayawada, without following the due process of law, as illegal and arbitrary, the petitioner has filed this Writ Petition.

Heard learned counsel for the petitioner as well as Sri R. Sudheer, learned Standing Counsel for the respondent Corporation.

Having regard to the limited grievance set out in the Writ Petition, this Court is the opinion that interests of justice would be served better if a direction is issued to the respondent Corporation to the effect that they shall follow the due process of law, if the demolition of the asbestos sheet shed in the subject premises is warranted. Ordered accordingly.

With this, the Writ Petition stands disposed of. No costs. Consequently, the miscellaneous Applications, if any shall also stand disposed of.
