O R D E R

In the present writ petition, the proceedings of Tenali Municipality under Section 228(3) of the A.P.Municipalities Act, 1965 (for short 'the Act'), is put in issue.

Counter is filed denying the allegations made in the writ petition. Heard.

When the matter was taken up hearing, It is stated by the learned counsel for the petitioner as well as the learned Standing counsel for respondents that the lis in the writ petition is squarely covered by order dated 09.06.2014 in W.P.No.10595 of 2013 and batch. Following the same, this writ petition is disposed of in terms of the above said order by setting aside the order passed under Section 228(1) of the Act and that the petitioner is granted four (4) weeks time from today to submit his reply to the notices issued under Sections 228(1) and (2) of the Act.

In case, the petitioner submits his reply within the aforesaid period of four (4) weeks from today, the respondent-Municipality shall consider the said reply, pass a reasoned order thereupon and communicate the same to the petitioner; and thereafter, take action in accordance with law. In case no reply is forthcoming, from the petitioner, within the aforesaid period of four (4) weeks, the proceedings issued under Section 228(3) of the Act would revive and the respondent-Municipality would be entitled to proceed and take action in accordance with law. There shall be no order as to costs.

As a sequel, miscellaneous petitions pending if any, shall stand closed.
