THE HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.30287 of 2017 ORDER:

This writ petition is filed seeking a writ of Mandamus to declare the action of the respondents in issuing the proceedings No.01/756(04)/2016KDG, dated 16.5.2017 by not providing compassionate appointment to the petitioner under the Bread Winner Scheme as illegal and arbitrary. A consequential direction is sought to appoint the petitioner on compassionate grounds.

Heard Sri I.Venkata Prasad, learned counsel for the petitioner and Sri Aravla Rama Rao, learned Standing Counsel for the respondentCorporation. It is the case of the petitioner that his father had worked as driver since 1990, in the respondent-Corporation and while working as driver, he had expired on 5.5.2016 unexpectedly. The petitioner had submitted an application on 2.6.2016 requesting the respondents to appoint him on compassionate grounds. His case was rejected by the respondentCorporation vide proceedings No.01/756 (04)/2016-KDG, dated 16.5.2017 on the ground that the father of the petitioner had committed suicide. Since it was unnatural death, the case of the petitioner cannot be considered on the ground that the Circular issued by the Corporation vide Circular No. PD17/2008, dated 26.2.2008 makes it very clear that dependents of employees
