HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL PETITION No.9030 of 2016 O R D E R:
This petition is filed by the petitioner-accused under Sections 437 and 439 of the Criminal Procedure Code seeking to grant bail to her in Crime No.95 of 2016 on the file of Rein Bazar Police Station, Hyderabad District, registered for the offence punishable under Sections 370 and 420 IPC.
It is alleged that the petitioner sent the daughter of the de facto complainant to Riyadh in the month of December, 2015 to work under Abdul Rahman Ali Mohammed, where the daughter of the de facto-complainant was subjected to physical and mental harassment and she was detained and thereafter, the petitioner contacted the daughter of the de facto complainant and demanded her to pay Rs.2 lakhs, if she wants to come back to India. Learned Counsel for the petitioner submitted that the petitioner was falsely implicated in the above crime and she has not committed any offence and that she has been in prison since 8.6.2016 and therefore, a lenient view may be taken.
Learned Additional Public Prosecutor opposed this petition. Considering the facts and circumstances of the case, this Court is not inclined to grant bail to the petitioner at this stage.
