THE HON'BLE THE CHIEF JUSTICE SRI KALYAN JYOTI SENGUPTA AND THE HON'BLE SRI JUSTICE SANJAY KUMAR WRIT PETITION No. 40775 of 2014 ORDER: (Per the Hon'ble the Chief Justice Sri Kalyan Jyoti Sengupta) We see that inconsistent statement has been made in the representation made before filing the writ petition, wherein it is alleged that temple land has been encroached, whereas, in the writ petition it is alleged that the Government land has been encroached. The petitioner shall take one correct stand.
Hence, the writ petition is dismissed on that ground alone. However, liberty is given to the petitioner to file a fresh writ petition in accordance with law, if so advised, stating correct and consistent facts. Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
