THE HON'BLE SRI JUSTI CE SANJAY KUMAR AND THE HON'BLE SRI JUSTI CE N. BALAYOGI WRI T PETI TI ON No. 42749 of 2016 ORDER: (per Hon'ble Sri Justice Sanjay Kumar) This writ petition is filed seeking implementation of the order dated 14.12.2015 passed by the Andhra Pradesh Administrative Tribunal, Hyderabad, in O.A.No.3897 of 2014. By the said order, the Tribunal set aside the proceedings dated 30.10.2014 rejecting the claim of the petitioner for payment of pensionary benefits and directed the authorities to release the pension and other benefits, including arrears, within eight weeks from the date of receipt of a copy of the order. Notice having been ordered, the learned Assistant Government Pleader for Services (Telangana) states that no writ petition was filed by the State assailing the aforestated order.
That being so, it is not open to the authorities to fail to implement the order passed by the Tribunal in the light of the undertaking given by the learned Advocate General for the State of Telangana, which was recorded by the Division Bench of this Court comprising the Hon'ble The Acting Chief Justice and the Hon'ble Sri Justice U. Durga Prasad Rao vide order dated 30.09.2016 passed in W.P.No.31905 of 2016 to the effect that the orders passed by the Tribunal, unless varied or set aside, would be invariably implemented.
The Writ Petition is accordingly disposed of directing the respondents to release the pension and other benefits including arrears in due implementation of the order dated 14.12.2015 passed by the Andhra Pradesh Administrative Tribunal, Hyderabad, in O.A.No.3897 of 2014. This exercise shall be completed expeditiously and, in any event, not later than four (4) weeks from the date of receipt of a copy of this order.
