THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM WRIT PETITION No. 7131 of 2015 ORDER:

The writ petitioner is aggrieved of the action of the 2nd respondent-revisional authority in not passing orders in the revision or at least in the stay application filed by him against the orders of the 3rd respondent, dated 31.07.2014.

2. The averments in the writ affidavit are to the effect that the on the recommendations of the 5th respondent-Tahsildar, the 4th respondentRevenue Divisional Officer, by orders dated 13.02.2008, cancelled the assignment granted in favour of the son of the petitioner on the ground that the son of the petitioner was a minor at the time of assignment. Challenging the cancellation, the petitioner filed an appeal before the 3rd respondent-Joint Collector. But the 3rd respondent, by orders dated 31.07.2014, confirmed the orders of the 4th respondent. Impugning the orders of the 3rd respondent, he filed a revision petition before the 2nd respondent-Chief Commissioner of Land Administration, and along with the revision, he filed a stay petition seeking stay of orders passed by the 3rd respondent. The petitioner states that no enquiry was made prior to initiating cancellation proceedings. It is his grievance that the 2nd respondent has neither disposed of the Stay application nor the Revision. till date.

3. Heard the petitioner's counsel and the learned Government Pleader.

4. Considering the fact that the Revision as well as the Stay application are pending before the 2nd respondent, this writ petition can be disposed of by directing the 2nd respondent to dispose of the Stay application, and preferably the Revision itself as expeditiously as possible. Till such time the Stay Petition is disposed of by the 2nd

respondent, there shall be Stay of eviction proceedings against the petitioner.

5. With the above direction, the writ petition is disposed of. No costs.

Miscellaneous petitions, if any pending in this writ petition, shall stand closed.
