G. Laxmaiah v. The State Of Telangana

HONOURABLE JUSTICE G. SRI DEVI CRIMINAL PETITION No. 4461 of 2019 ORDER:

This Criminal Petition, under Section 482 Cr.P.C., is filed by the petitioner/ accused, seeking to quash the proceedings in Crime No.48 of 2019 of Kandukur Police Station, Rachakonda Commissionerate, registered for the offences punishable under Section 374 of IPC and Section 79 of Juvenile Justice Act, Section 14(1) of Child Labour Act, 1986 and Section 3(1)(vi) of Scheduled Castes and Scheduled Tribes (Prevention of Attrocities) Act, 1989.

Though the criminal petition is filed to quash the aforesaid proceedings, during the course of arguments, learned counsel for the petitioner restricts his prayer seeking a direction to the Investigating agency to follow the procedure prescribed under Section 41-A Cr.P.C. and the guidelines prescribed by the Apex Court in Arnesh Kumar v. St at e of Bihar and anot her 1.

The learned Additional Public Prosecutor fairly concedes the request of the learned counsel for the petitioner. 4.

In that view of the matter, the Criminal Petition is disposed of directing the police concerned to follow the provisions under Section 41-A Cr.P.C. and abide by the directions of the Apex Court as set out in Arnesh Kumar's case (supra). However, no coercive steps shall be taken against the petitioner.

As a sequel thereto, miscellaneous petitions, if any, pending shall stand closed.
