The Criminal Petition is filed under Section 482 of BNSS praying this Court to grant pre-arrest bail to the petitioner who is arrayed as accused in Crime No.343 of 2026 before the Malkajgiri Police Station, Malkajgiri District, registered for the offence punishable under Section 69 of BNS.

Brief facts of the case are that on 24.04.2026 at 17:00 hours, a petition was received from the de-facto complainant stating that about three years ago she became acquainted with Nyeikapula Pranav, who initially developed a friendly relationship with her. From June, 2025, he began expressing his love and repeatedly proposed marriage which she initially refused. However, upon his continuous proposals and assurance that he would marry her she accepted. Thereafter, they remained in regular contact through phone calls and WhatsApp messages. During the period when the complainant was residing alone at Flat No.
202, Madhu Chaitanya Apartments, Vasantha Vihar Colony, Moula Ali, while her mother was in Kuwait for employment, Pranav visited her residence, established physical relations with her on multiple occasions on the false promise of marriage and also stayed with her for some days. Subsequently, even after the complainant shifted to Flat No.307, Sushipa Hills Apartment, MJ Colony, he continued to visit her residence and maintained physical relations with her on several occasions under the same assurance of marriage. On 15.04.2026 Pranav invited the complainant to his house and had physical intercourse with her.
marriage he refused stating that he did not wish to marry her, and began avoiding her and her phone calls. Hence, the complainant requested to take necessary action. Based on the said complaint a case was registered against the accused person for the above offences and investigation was taken up. 3.
Heard Sri Lattupally Anand, learned counsel for petitioner, and Sri M.Ramachandra Reddy, learned Additional Public Prosecutor appearing for the respondent-State. 4.
The learned counsel for the petitioner contends that the petitioner is innocent of the allegations made against him. It is further contended that the relationship between the complainant and the petitioner is a consequential relationship, as they have been in a relationship for about three years, and in view of the settled position of law, the same cannot be construed otherwise. He further submits that the petitioner is ready and willing to cooperate with the police in the course of investigation. Therefore, he prays that this Court may be pleased to grant anticipatory bail to the petitioner by allowing the present criminal petition.

On the other hand, learned Additional Public Prosecutor opposed the submissions made by the learned counsel for the
petitioner stating that the allegations leveled against the petitioner are serious in nature. Further, the investigation was not yet completed. At this stage, granting of pre-arrest bail to the petitioner does not arise. Therefore, he prayed the Court to dismiss the criminal petition.

Considering the material available on record and the averments made in the petition, it is evident that there existed a relationship between the parties for a period of about three years and thereafter the petitioner refused to marry the complainant. In view of the relationship between the parties and the overall circumstances of the case, this Court is of the considered opinion that custodial interrogation of the petitioner is not necessary. Accordingly, this Court deems it appropriate to grant pre-arrest bail to the petitioner, subject to compliance with the following conditions:
i.
The petitioner shall surrender before the Station House Officer, Malkajgiri Police Station, Malkajgiri District, within two weeks from today, and on such surrender, the said Station House Officer shall release petitioner on bail, on their executing a personal bond for
Rs.25,000/- (Rupees Twenty Five Thousand only), with two sureties, for the like sum each.
ii.
The petitioner shall abide by the other conditions stipulated in Section 482(2) of Bharatiya Nagarik Suraksha Sanhita, and co-operate with the Investigating Officer in investigating the case.
iii.
The petitioner shall appear before the concerned Investigating Officer on every Wednesday between 09:00 a.m, and 05:00 p.m., till the filing of the charge sheet and thereafter, as and when required.

Accordingly, this Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
