HON'BLE SRI JUSTICE M. SATYANARAYANA MURTHY CRIMINAL PETITION No.3042 of 2014 ORDER :
This criminal petition is filed by the petitioners/A.4 and A.5 under Section 482 of the Code of Criminal Procedure, 1973 (for short, 'the Cr.P.C.') to quash the proceedings in C.C.No.559 of 2012 on the file of the I-Additional Judicial First Class Magistrate, Warangal, for the offences punishable under Section 498-A IPC and Sections 3 and 4 of the Dowry Prohibition Act.

Along with the criminal petition, the petitioners filed a petition for grant of interim stay of all further proceedings, but this Court passed the following order:
"Issue notice to the second respondent.
Learned counsel for the petitioners is permitted to take out personal notice to the second respondent by "Registered Post with Acknowledgment Due" and file proof of service. Post on 09.04.2014.
Meanwhile, the presence of the petitioners/A.4 and A.6 in C.C.No.559 of 2012 on the file of the Judicial First Class Magistrate, Warangal, is dispensed with except on the dates when their presence is specifically required by the learned Magistrate.
It is made clear that the pendency of this petition shall not come in the way of the learned Magistrate in proceeding further with the case."

During hearing, learned counsel for the petitioners and respondent No.2 agreed to dispense with the presence of the
petitioners in C.C.No.559 of 2012 and allow them to proceed with the trial.

In view of the request made by both the parties and without touching the merits of the criminal petition, the appearance of the petitioners/A.4 and A.5 in C.C.No.559 of 2012 on the file of the I-Additional Judicial First Class Magistrate, Warangal, is dispensed with except on the dates when their presence is specifically required by the learned Magistrate.

With the above direction, the criminal petition is disposed of, directing the learned Magistrate to dispose of C.C.No.559 of 2012 as expeditiously as possible.
