HON'BLE SRI JUSTICE A.RAJASHEKER REDDY WRIT PETITION No.13517 OF 2018 ORDER:

Heard learned counsel for the petitioners and the learned Assistant Government Pleader appearing for the respondents. 2.

This Writ Petition is filed seeking the following relief: "to issue a Writ or order or direction more in the nature of Writ of Mandamus directing the respondents to implement the Judgment dated 09.12.2015 in OA No 3366 of 2015 on the file of the Honble Andhra Pradesh Administrative Tribunal by transferring the petitioners in the existing vacancies available at MPPS CJI Thanda, Kamapally Mandal, Khammam District, and MPPS Vepalagada Thanda, Illandu Mandal, Bhadradri Kothagudem District, with all consequential benefits by holding the action of the respondents in not implementing the Judgment dated 09.12.2015 in OA No 3366 of 2015 and batch and further implementing the same in respect of other similarly situated teacher vide proceeding dt 3.2.2018 issued by the 2nd respondent is as illegal arbitrary discriminatory and subversive of Articles 14 and 16 of the Constitution of India."

Learned counsel for the petitioners submits that the respondents have not implemented the judgment, date 09.12.2015 in O.A.No.3366 of 2015 passed by the Andhra Pradesh Administrative Tribunal, for transfer of petitioners in the existing vacancies though similarly placed persons like petitioners, who approached the Tribunal and obtained orders, the respondents have implemented the said judgment by issuing proceedings Rc.No.4585/A7/Estt/2017, dated 03.02.2018. He further submits that the petitioners have filed representations on 16.07.2015 and 09.02.2018 to consider their case as per the said judgment, but till date no orders are passed thereon.

In view of the above factual circumstance, this Writ Petition is dispose of directing the respondents to consider the representations of the petitioners, dated 16.07.2015 and 09.02.2018, and take action before conducting next counselling for transfers.

Miscellaneous petitions, if any, pending in this writ petition shall stand closed. There shall be no order as to costs. ___________________________ A.RAJASHEKER REDDY, J APRIL 18, 2018 Note:
