This civil revision petition under Article 227 of the Constitution was filed by the respondent in O.P.No.791 of 2015 and M.C.No.136 of 2015, both cases pending on the file of the learned Judge, III Additional Family Court, Ranga Reddy District at Malkajgiri. The cause for grievance was that the petitioner, being the respondent in both cases, filed Memo dated 05.01.2017 praying that a common trial be conducted in the two cases. Aggrieved by the inaction on the part of the trial Court thereon, the present civil revision petition was filed.

By order dated 03.02.2017, this Court took note of the fact that the trial Court had already commenced the trial in M.C.No.136 of 2015 without clubbing both the cases for a joint trial and accordingly granted interim stay of further proceedings before the Court below. Notice having been served upon the respondents, the petitioners in both the cases pending before the Family Court, Sri P.Suryanarayana Murthy, learned counsel, entered appearance. He states on instructions that his client has no objection if both the cases are clubbed together for a joint trial.

In that view of the matter, the C.R.P. is allowed. The trial Court shall accordingly accept and act upon the Memo dated 05.01.2017 filed before it by the petitioner herein seeking a joint trial in O.P.No.791 of 2015 and M.C.No.136 of 2015 pending on its file. Pending miscellaneous petitions, if any, shall also stand dismissed. No order as to costs.
