This Criminal Petition is filed under Section 480 & 483 of Bharatiya Nagarik Suraksha Sanhita, 2023 praying this Court to enlarge the petitioners on bail who are arrayed as accused Nos.1 to 4 in Crime No.478 of 2026 of Hayathnagar Police Station, Malkajgiri District. The offences alleged against the petitioners are under Sections 74, 79, 118(1), 329(4), 351(2) r/w 3(5) of Bharatiya Nyaya Sanhita, 2023 (for short 'BNS') and Sections 7 r/w 8 and 11 r/w 12 of the POCSO Act, 2012. 2.

The facts of the case are that on 23.03.2026, the de-facto complainant lodged a complaint stating that a person named

- 2 - Yellaiah has a scrap shop behind their house. On 23.03.2026, around at 20:00 hours, it was learned that a stray dog in their colony had bitten their child. They mistakenly thought that the child was bitten by complainant pet dog and Yellaiah, Satish, Naga, Rajesh and 30 other people entered their house illegally and attacked her husband, complainant, her children, her eldest daughter Likhita, 17 years old, her second daughter Ujwala, Maisri, Nityasri. They not only beat them all severely, but also beat her children who are minors, beat them and touches the other private parts, behaved very rudely. They held her tightly and cursed her with indescribable her. They beat her, her husband, her children and tortured her. Hence, requested the police to take necessary action against the accused persons basing on which the presence crime is registered against the accused persons for the above offences. 3.

Heard Sri U. V. Suresh Kumar, learned counsel appearing on behalf of the petitioners and Sri M. Ramachandra Reddy, learned Additional Public Prosecutor appearing on behalf of the respondent - State.

The contention of learned counsel for the petitioners is that the petitioners are innocent of the said allegations and the de-facto complainant is running Kirana shop in his house and

- 3 - the petitioners herein made complaint against the de-facto complainant. It is further submitted that keeping the said grudge, a false case is registered against the petitioners and they are in jail since 29.03.2026 and the material part of the investigation was already completed. Hence, prayed this Court to grant regular bail to the petitioners 5.

On the other hand, learned Additional Public Prosecutor opposed bail contending that the offence committed by the petitioners is serious in nature. It is further submitted that, not only this case, earlier also three other crimes with similar allegations were registered against the petitioners. Further, the investigation is not yet completed. Hence, petitioners are not entitled to bail and prayed to dismiss this petition. 6.

Considering the submissions made by both the counsel and the material on record, the petitioners herein are in jail since 29.03.2026. As seen from the remand case diary, the prosecution witnesses, LWs 1 to 12 have already been examined and though there are other cases registered against the petitioners, in the present case, the material part of the investigation was already completed, considering the allegations against the petitioners, this Court is inclined to grant regular bail to the petitioners subject to the following conditions:

The petitioners shall execute a personal bond for a sum of Rs.25,000/- each (Rupees Twenty Five Thousand only) with two sureties for a like sum each to the satisfaction of the learned Special Sessions Judge for trial and Disposal of cases under POCSO Act, Ranga Reddy District, at L.B. Nagar.

ii.

The petitioners shall appear before the concerned SHO between 09.00 a.m and 5.00 p.m., on every Monday for a period of eight (8) weeks or till filing of charge sheet whichever is earlier, for the purpose of investigation, and thereafter, as and when required.

iii.

The petitioners shall abide by the conditions stipulated in Section 483(2) of the BNSS.

Accordingly, the Criminal Petition is allowed. Miscellaneous applications, if any pending, shall stand closed.
