HON'BLE THE ACTING CHIEF JUSTICE RAMESH RANGANATHAN ARBITRATION APPLICATION NO.136 OF 2015 ORDER:

By order in Arbitration Application No.136 of 2015 dated 06.01.2017, this Court appointed Sri Syed Lateef-Ur_Rahman, Retired District Judge, Hyderguda, Ranga Reddy District as the sole arbitrator to resolve the disputes arising out of the development agreement-cumgeneral power of attorney dated 26.04.2012. The Learned Arbitrator addressed a letter to this Court on 25.03.2017 informing that he was appointed as the Chairman, Permanent Lok-Adalat, Warangal; he assumed charge on 17.03.2017; and, as such, he was unable to continue the proceedings.

As the previous arbitrator has expressed his inability to continue to arbitrate the disputes, it is necessary that an arbitrator be appointed in his place. When the matter came up earlier on 21.04.2017, there was no representation on behalf of the respondents and, as such, the application was directed to be listed under the caption 'for orders' today. Even today there is no representation on behalf of the respondents. I consider it appropriate, therefore, to appoint Sri T.Ashok Kumar, Retired District Judge, 101, Bapuji Nagar, Habsiguda, Ratna Nidhi Residency, Hyderabad, as the arbitrator. The Learned Arbitrator shall fix his remuneration, and incidental charges for the arbitration proceedings, in consultation with the parties. He shall complete arbitration proceedings, and pass an award at the earliest, preferably within a period of six months from the date of commencement of arbitral proceedings. He is also requested to hold sittings, as far as possible, in the mediation centre of the High Court.
