O R D E R
This petition is filed under Section 482 Cr.P.C. to quash the proceedings against the petitioners / A-3 to A-5 in C.C.No.148 of 2016 on the file of Additional Judicial First class Magistrate at Gudivada.
At the time of hearing, the learned counsel for the petitioners submitted that A-1 has been attending the court and, therefore, the only relief that he is seeking in this petition, is to dispense with the presence of the petitioners, who are A-2 to A-5, during trial.
Heard the learned Public Prosecutor for the State of Andhra Pradesh. In view of the submission made by the learned counsel, this court is not inclined to go into the merits of the main case. There is no dispute with regard to identity of the petitioners. Even if the presence of the petitioners is dispensed with, no prejudice would be caused to the 1st respondent. Having regard to the facts and circumstances, the presence of the petitioners / A-3 to A-5 in C.C.No.148 of 2016 on the file of Additional Judicial First Class Magistrate at Gudivada is dispensed with on each and every date of hearing. However, they shall appear before the trial court as and when their presence is required.
