THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY WRIT PETITION No.22870 of 2016 ORDER:
This writ petition is filed under Article 226 of the Constitution of India to issue a writ of Mandamus declaring the action of the 1st Respondent a) Commencing the process of counseling with effect from 05.7.2016 in respect of undergraduate Pharmacy courses without concluding the process of affiliation in respect of the college before 15th May 2016 as mandated in the case of Parshvanath Charitable Trust v. All India Council for Technical Education, reported in (2013) 3 SCC 385 resulting in non-inclusion of the Petitioner in the list of colleges for counseling; b) Communication of deficiencies in respect of the petitioner institution in pursuance of the application made by the petitioner for affiliation vide proceedings dt.08.7.2016 with time for compliance till 23.7.
2016; c) and in the meantime proceeding with further process of counseling and allotment of students for academic year 2016-17 as arbitrary, illegal and in derogation of the schedule fixed by the Supreme Court of India with consequential direction to respondents to include all the approved courses of the Petitioner college for counseling and allotment of students for Academic year 2016-17 by granting affiliation to the approved courses for the academic year 2016-17.
2. The learned counsel for the petitioner seeks permission of this court to permit the petitioner to withdraw the writ petition. Permission is granted.
3. Accordingly, the writ petition is dismissed as withdrawn. Miscellaneous petitions if any pending in this writ petition shall stand closed.
