Heard learned counsel appearing for the petitioner and learned Government Pleader for Home appearing for respondents 1 to 3.
This writ petition is filed challenging the inaction of respondent-police in registering FIR No.823 of 2016, dated 17.12.2016, under Section 420 IPC, based on the complaint lodged by the 4th respondent.
The case is under investigation. A reading of the complaint does not show that registration of crime is bad in law. In view of the same, this Court is not inclined to interfere with the registration of crime. However, the 3rd respondent shall follow due process of law, during the course of investigation, including compliance of provisions under Section 41-A of the Criminal Procedure Code.
