The Court made the following:

ORDER:

The petitioner filed this Writ Petition for a general direction to the respondents not to intercept the lorries transporting sand, under valid permits, from the State of Orissa to the State of Andhra Pradesh and seize them.

As rightly submitted by Mr. Krishna Prakash, learned Special Government Pleader, the petitioner has not cited any specific instance of interception of sand laden lorries covered by valid permits.

In my opinion, it is not appropriate to entertain a Writ Petition of this nature, where the grievance of the petitioner is generic in nature without basing on specific instance of illegal seizure. In this view of the matter, the Writ Petition is dismissed, however, with liberty to the petitioner to avail appropriate remedy if and when the respondents intercept sand transportation based on valid permits.

As a sequel to dismissal of the Writ Petition, W.P.M.P.No.48307 of 2015 shall stand dismissed as infructuous. ____________________________ JUSTICE C.V.NAGARJUNA REDDY 18th November, 2015 DR
