THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.33776 of 2017 ORDER:

Heard learned counsel for the petitioner, learned Government Pleader for Education and Smt.A.Chaya Devi, learned Standing Counsel, apart from perusing the entire material available on record.

The inaction, on the part of respondent Nos.2 and 3, in passing orders, pursuant to the letter addressed by the fourth respondent herein, pertaining to the request of the petitioner herein for inclusion of surname, is under challenge in the present Writ Petition.

A counter-affidavit, deposed by the Regional Officer, CBSE, Chennai, is placed before this Court. The penultimate portion of the said affidavit reads as under: "Further, as mentioned in these paras and the documents submitted by the petitioner, the name of the petitioner is mentioned as B.Lanesh Karthik bearing Roll No.4066246/2015 which was as per the List of Candidates (LOC online Registration) submitted by the concerned school. However, the Board is ready to consider the request for correction in Candidate Name based on Amended Rule in Exam Byelaws ignoring the time limit of 1 year provided the School documents mentioned above is submitted through the school concerned duly attested".

By placing the above contents of the counter-affidavit on record, Writ Petition is disposed of, directing the fourth respondent herein to send the following documents to

respondent Nos.2 and 3 for their consideration, within a period of one month:

a. True copy of Admission form(s) filled in by the parents at the time of admission duly attested by the Head of the concerned institution.

b. True copy of the School Leaving Certificates of the previous school submitted by the parents of the candidates at the time of admission duly attested by the Head of the concerned institution.

c. True copy of the portion of the page of admission and withdrawal register of the school where the entry has been made in respect of the candidate duly attested by the Head of the concerned institution.

d. The Board may affect necessary corrections after verification of the original records of the school and on payment of the prescribed fee.

Thereafter, within a period of six weeks, respondent Nos.2 and 3 shall take appropriate action, strictly in accordance with law.

Miscellaneous petitions, if any, pending in this Writ Petition, shall stand closed. There shall be no order as to costs. ___________________ A.V. SESHA SAI, J 06th November, 2018 Note:
