HON'BLE SRI JUSTICE S. RAVI KUMAR TRANSFER C.M.P.No.459 of 2016 ORDER:

This petition is filed to withdraw F.C.O.P.No.950 of 2016 from the file of Family Court, Ranga Reddy at L.B.Nagar, and transfer the same to Additional Family Court, Visakhapatnam. 2.

Wife filed this petition. According to her affidavit, her marriage with respondent was solemnized on 07.12.2008 and during their wedlock a male child was born. She stated that she was subjected to cruelty and harassment both by respondent and his family members and finally she was driven out from the matrimonial house and having no other alternative, she went to her parents house along with child and filed F.C.O.P.No.1003 of 2011 before Additional Family Court, Visakhapatnam, for maintenance and other reliefs. She further stated that respondent herein filed F.C.O.P.No.950 of 2016 before Family Court, Ranga Reddy at L.B.Nagar, with all false allegations. She stated that distance between her parents house and Hyderabad is about 700 kms. and she is not having any independent income to meet the travelling and other expenses.

She stated that being a woman it is difficult for her to travel for such long distance with tender age child and respondent is already attending Additional Family Court, Visakhapatnam, therefore, it may not be any difficult for him to attend for this case also. For these reasons, she prayed for transfer of F.C.O.P.No.950 of 2016 from Family Court, Ranga Reddy at L.B.Nagar to Additional Family Court, Visakhapatnam.

This Court permitted petitioner to take personal notice to respondent through registered post with acknowledgment due and advocate for petitioner filed memo on 29.08.2016 stating that notice sent to respondent is returned with an endorsement "refused" and filed the returned postal cover along with memo.

Heard advocate for petitioner.

Considering the reasons stated in the affidavit filed in support of petition and also considering convenience of wife, F.C.O.P.No.950 of 2016 is withdrawn from Family Court, Ranga Reddy at L.B. Nagar, and transferred to Family Court, Visakhapatnam, for disposal in accordance with law.

Transfer C.M.P. is ordered accordingly.
