THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL REVISION CASE No.143 OF 2006 ORDER:

The petitioner has preferred the present criminal revision case by invoking the provisions under Sections 397 and 401 of Code of Criminal Procedure (Cr.P.C.,) being aggrieved by the order dated 03.01.2006 passed in Crl.M.P.No.130 of 2005 in S.C. No.154 of 2002 by the Court of the VII Additional District and Sessions Judge (FTC), Nizamabad, at Bodhan, whereby the learned Judge dismissed the petition filed by the petitioners/A.1 to A.3 under Section 311 CrPC., to summon Dr M.Ravinder Reddy, Professor and Head of the Department, Forensic Medicine, Osmania Medical College, Koti, Hyderabad, as defence witness. Heard and perused the material available on record. Learned counsel for the petitioners/A.1 to A.3 submits that the trial has already been completed in S.C.No.154 of 2002 and as such, the criminal revision case has become infructuous. The criminal revision case is accordingly dismissed as infructuous.
