THE HON'BLE SRI JUSTICE A.V.SESHA SAI WRIT PETITION No.27053 of 2017 ORDER:

Heard learned counsel for the petitioner, and Sri Pasam Krishna Reddy, learned Standing Counsel for GHMC. The only grievance of the petitioner in the present Writ Petition is that, pending civil suit vide O.S.No.584 of 2017 on the file of the XVIII Senior Civil Judge, City Civil Court, Hyderabad, the unofficial respondents are proceeding with construction in the subject property.

Even according to the petitioner herein he filed the above suit against the unofficial respondents herein for cancellation of sale deed bearing document No.163/2017 dated 10.01.2017 and for recovery of possession. It is clear from the material available on record that an application is also filed before the Civil Court for injunction. Admittedly, the said suit and the injunction application are pending before the Civil Court. Therefore, this Court does not find any valid reason to entertain the present Writ Petition under Article 226 of the Constitution of India. However, it is open for the petitioner herein to pursue the said civil suit pending before the Court below.

With the above, the Writ Petition stands disposed of. Miscellaneous petitions, if any, pending shall stand closed. There shall be no order as to costs.
