ORDER:

This writ petition is filed for a mandamus to declare the action of the respondents in rejecting the petitioners' application, dated 20.01.2012, for permission to construct stilt + Ground + 3 upper floors, as illegal and arbitrary.

Today, this Court has disposed of W.P.No.4950 of 2014 and directed respondent No.4 to regularise the petitioners' plot. The learned counsel for the petitioners submitted that in view of this subsequent event, the petitioners may be permitted to withdraw the writ petition with liberty to make a fresh application for permission after regularisation of their plot.

Accordingly, the writ petition is dismissed as withdrawn with the

liberty to the petitioners in terms of the prayer made. As a sequel to dismissal of the writ petition, WP.M.P.No.41136 of 2012 shall stand disposed of as infructuous.
