THE HON'BLE SRI JUSTICE A.RAJASHEKER REDDY W.P.Nos.25083 of 2009, 21856 & 33328 OF 2010 COMMON ORDER:

Since the subject property of these writ petitions is one and the same and since the petitioner in WP.Nos.25083/2009 and 33328/2010 is the 5th respondent in WP.No.21856 of 2010, all these writ petitions are heard together and disposed of by this common order.

The parties will be referred to as they are arrayed in WP.No.21856 of 2010.

This Court while admitting the WP.No.21856 of 2010 on 02.09.2010 granted order of Status quo with regard to entries in the record of rights. Thereafter, counters are also filed. Today, when the matter is listed both the counsel state that the 5th respondent herein and his son filed OS.No.2 of 2012 for partition and the Court below on 06.09.2012 passed exparte preliminary decree and that the suit is pending for final decree. Learned counsel for the petitioners submits that they have filed a petition to set aside the exparte preliminary decree passed by the Court below on 06.09.2012.

Both the counsel agreed for disposal of these writ petitions stating that the parties will abide by the result in OS.No.2 of 2012 and that Status quo can be continued till the disposal of the said suit.

In view of the above without going into the merits of the case, all these writ petitions are disposed of and both the parties shall maintain Status quo, in all respects, as ordered by this Court in WP.No.21856 of 2010 on 02.09.2010, till the disposal of OS.No.2 of 2012. However, the parties shall work out their remedies depending upon the result in OS.No.2/2012. No order as to costs.

As a sequel thereto, miscellaneous petitions, if any, pending in the writ petitions, shall stand closed. _____________________________ A.RAJASHEKER REDDY, J 14.11.2016 t k.
