Counsel for the Petitioner: Dr.J.Vijayalakshmi Counsel for the respondents: AGP for Agriculture (AP) The Court made the following:
Order:
This Writ Petition is filed for a Mandamus to declare Proeeding No.A1/188/2/2011, dated 23-122011, of respondent No.2, whereby the petitioner was directed to vacate stall No.81-82 in Kedareswarapeta Rythu Bazaar, Vijayawada, by cancelling the allotment, earlier made in its favour, without following the due process of law, as illegal and arbitrary. At the hearing, Dr.J.Vijayalakshmi, learned
Counsel for the petitioner, has not disputed that this Writ Petition is identical to several Writ Petitions, which were disposed of by this Court; that against Order, 19-11-2014, passed in one such Writ Petition being WP.No.36108 of 2012, a Writ Appeal, namely, WA.No.1613 of 2014 has been filed; and that the Division Bench vide its Judgment, dated 18-12-2014, while confirming the order of this Court, slightly modified the same by directing the Joint CollectorExecutive Officer to consider letter No.RBZ/934/2013, dated 29-11-2013, of the Chief Executive Officer, Rythu Bazaars, Hyderabad, within a fortnight. In view of the above facts, this Writ Petition is also disposed of in terms of Order, 19-11-2014, in WP.No.36108 of 2012, with the only modification that respondent No.2 shall consider letter No.
RBZ/934/2013, dated 29-11-2013, of the Chief Executive Officer, Rythu Bazaars, Hyderabad, for extension of term of the petitioner at his discretion within two weeks from the date of receipt of this order. As a sequel to disposal of the Writ Petition, WVMP.No.1206 of 2012 in/& WPMP.No.716 of 2012 are disposed of as infructuous.
