THE HON'BLE SRI JUSTICE A.V. SESHA SAI WRIT PETITION No.6147 of 2012 ORDER:

This writ petition is filed under Article 226 of the Constitution of India seeking the following relief:

"to issue writ of Mandamus to declare the inaction of the respondents No.1 in not taking action against the respondent No.2 and 3 for their harassment against the petitioner in not attending his official duties without registering any crime is illegal unjust and consequently direct the respondent No.2 and 3 not to harass the petitioner and calling police station and obstructing his official duties pending disposal of the Writ Petition and pass such other or further orders as this Hon'ble Court deems fit and proper."

Heard Sri Kothapalli Ram Mohan Chowdary, learned counsel for the petitioner and learned Government Pleader for Home for respondents, apart from perusing the material available before this Court. When the matter is called today, written instructions dated 13-03-2012, furnished by the Sub-Inspector of Police, Mahila Police Station, Anantapur, have been placed on record by the learned Government Pleader for Home and the said instructions read as under:

"It is submitted that, the wife of the petitioner by name Tharigopula Sreelakshmi @ Lakshmidevi has lodged a complaint on 9.3.2012 with the SHO Mahila P.S. Anantnnnr District/2nd respondent herein stating that her marriage was performed with the petitioner on 29.8.2010 and after the marriage her husband/petitioner and family members have harassed her for additional dowry and beat her and requested to take necessary action. Basing on the said complaint a ease in Cr.No. 14/2012 U/s. 498-A, 506 r/w. 34 IPC & Section 3 & 4 of D.P. Act has been registered on 9.3.2012 against 1) Tharigopula Sanjeeva Rayudu/petitioner 2) T.Ramanjaneyulu, 3) B.Laxmi Devi and 4) B.Govindappa as A-1 to A-4.

A-1, A-2, A-4 were arrested on 9.3.2012 and sent to judicial custody. A-3 is absconding. The matter is under investigation. It is incorrect to say that on 2.3.2012 the respondents 2 and 3 visited the petitioner's school.

Except registering the above crime against the petitioner herein and his family members, the respondents police never harassed the petitioner at any point of time." On noticing the above said instructions, learned counsel for the petitioner has requested this Court to record the said instructions and dispose of the writ petition.

In view of the above, the writ petition stands disposed of, by recording the written instructions, dated 13-03-2012, furnished by the Sub-Inspector of Police, Mahila Police Station, Anantapur.
