THE HON'BLE SRI JUSTICE RAJA ELANGO CRIMINAL APPEAL No.748 of 2010 JUDGMENT:

This Criminal Appeal is filed by the appellant - Accused against the judgment, dated 10.03.2010, passed in S.C. No.444 of 2009 by the II Additional District & Sessions Judge, Chittoor at Madanapalle.

When the matter is taken up for hearing, learned counsel for the petitioner submitted that the cause in this criminal petition does not survive for adjudication since the petitioner was released on remission and hence, the criminal petition has become infructuous and to that effect he has filed letter, dated 27.07.2016, which reads as under: "The above Criminal Appeal No.748 of 2010 was filed against S.C. No.444 of 2009 on the file of II Additional District and Sessions Judge, Chittoor at Mandanapalli. Now the appellant was released on remission rules on 2.7.2015. Therefore the Crl.A.No.748 of 2010 become infructuous and kindly direct the registry to post the above Crl.A. No.748 of 2010 for withdrawal in tomorrow's cause list." Recording the same, Criminal Appeal is dismissed as infructuous.

Miscellaneous petitions, pending if any, shall stand closed.
