THE HON'BLE JUSTICE G.SRI DEVI CRIMINAL PETITION No.4445 of 2019 ORDER:

This Criminal Petition, under Section 482 of Code of Criminal Procedure, 1973, is filed by the petitioners/accused Nos.1 to 5 seeking to quash the proceedings against them in C.C.No.432 of 2017 on the file of XVI Additional Chief Metropolitan Magistrate, Hyderabad.

Heard the learned counsel for the petitioners/Accused Nos.1 to 5 and the learned Additional Public Prosecutor representing the 1st respondent-State. Perused the record.

Though learned counsel for the petitioners filed the petition for quashing the proceedings in the aforesaid Calendar Case, he restricts his prayer seeking dispensation of personal appearance of the petitioners/Accused Nos.1 to 5 before the Court below in the aforesaid Calendar Case.

Having regard to the facts and circumstances of the case and considering the request of learned counsel for the petitioners, without expressing any opinion on the merits of the case, the personal appearance of the petitioners/Accused Nos.2 to 5 in C.C.No.432 of 2017 on the file of XVI Additional Chief Metropolitan Magistrate, Hyderabad, is only dispensed with, while permitting the them to make their appearance through their counsel.

However, the petitioners/Accused Nos.2 to 5 shall appear before the Court below as and when their personal appearance is so warranted, in respect of the aforesaid Calendar Case. The prayer sought for by the learned counsel for the petitioners seeking dispensation of personal

appearance of petitioner No.1/accused No.1 before the Court below is rejected.

With the above direction, the Criminal Petition is disposed of. Miscellaneous petitions, if any, pending in this criminal petition shall stand closed.
