HON'BLE SRI JUSTICE GUDISEVA SHYAM PRASAD W.P. No.371 of 2016 ORDER:

This Writ Petition is filed under Article 226 of the Constitution of India, seeking the following relief: "...to issue a Writ or order or direction more particularly in the nature of Writ of Mandamus declaring the action of the respondents in calling the petitioner to the police station in Civil disputes is illegal, arbitrary, unjust and violation of principles of Natural Justice and violation of Article 21 of Constitution of India and consequently direct the respondents not to call the petitioner to the police station in Civil disputes daily and to pass such orders as it may deems fit and just."

2) Heard learned counsel for petitioner and learned Assistant Government Pleader for Home appearing for respondent Nos.1 to 5.

3) Learned counsel for the petitioner submits that respondents 4 & 5 are calling the petitioner to the police station for negotiations in connection with civil disputes and therefore, he filed the present writ petition seeking a direction to the police not to interfere in civil disputes.

4) Learned Assistant Government Pleader for Home submits that the police have not been interfering in civil disputes and they have never called the petitioner to the police station. In support of the said contention, the Assistant Government Pleader has submitted the written instructions given by the Sub-Inspector of Police, Chebrolu P.S., Guntur Urban, wherein it is stated that the respondent-police did not receive any complaint from anybody

including 6th respondent to register the FIR, hence calling the petitioner to the police station, to settle the issue does not arise. 5) However, in view of the fact that the petitioner has stated in his affidavit that the police are calling him to the police station in connection with the settlement of civil matters, the respondents are directed not to interfere in civil matters of petitioner.

6) With the above direction, the Writ Petition is disposed of. No order as to costs.

Consequently, miscellaneous petitions, if any, pending in this appeal shall stand closed.
