Tr.C.M.P.No.526 of 2016 is filed under Section 24 of CPC seeking to withdraw S.O.P.No.40 of 2014 on the file of the Court of II Additional Senior Civil Judge, Vijayawada, Krishna District and transfer the same to Family Court-cum-IX Additional District Judge, Rajahmundry, East Godavari District.

Tr.C.M.P.No.527 of 2016 is filed under Section 24 of CPC seeking to withdraw O.S.No.44 of 2016 on the file of the Court of Principal Junior Civil Judge, Narasaraopet, Guntur District and transfer the same to Family Court-cum-IX Additional District Judge, Rajahmundry, East Godavari District.

Tr.C.M.P.No.902 of 2016 is filed under Section 24 of CPC seeking to withdraw F.C.O.P.No.1 of 2016 on the file of the Family Court-cum-IX Additional District Judge, Rajahmundry, to any of the Court at Vijayawada, Krishna District.

The point involved in three matters is one and the same, this Court is inclined to pass common order in all the three matters. 5.

Heard the learned counsel for the petitioners, learned counsel for the respondents and perused the material on record. 6.

At the time of arguments, both the counsel with one voice submitted that in order to avoid inconvenience to both parties, all the matters may be transferred to main Family Court, at Vijayawada, Krishna District.

In view of the submissions made by both the counsel, this Court is not inclined to go into the merits of the main case. However, in order to avoid conflicting of judgments, this Court is of the considered view that it is a fit case to transfer all the matters to one Court.

Having regard to the facts and circumstances of the case, S.O.P.No.40 of 2014 on the file of the Court of II Additional Senior Civil Judge, Vijayawada, Krishna District, O.S.No.44 of 2016 on the file of the Court of Principal Junior Civil Judge, Narasaraopet, Guntur District, and F.C.O.P.No.1 of 2016 on the file of the Family Courtcum-IX Additional District Judge, Rajahmundry, are withdrawn and transferred to main Family Court, Vijayawada, Krishna District, for disposal in accordance with law.

With the above observation, all the three transfer C.M.Ps.No.526, 527 and 902 are disposed of. As a sequel, miscellaneous petitions pending, if any, shall stand closed. ________________________ T.SUNIL CHOWDARY, J 14th June 2018 Rns
