O R D E R

This civil revision petition under Article 227 of the Constitution arises out of the order dated 14.07.2017 passed by the learned XVI Additional District Judge, Ranga Reddy District at Malkajgiri, in I.A.No.428 of 2017 in O.S.No.1399 of 2016. This I.A. was filed by the petitioner, the third defendant in the suit, under Order 7 Rule 11 CPC seeking rejection of the plaint. By the order under revision, the trial Court dismissed the I.A. Aggrieved thereby, the third defendant is before this Court.

Sri Pushadapu Subba Rao, learned counsel for the petitioner, fairly states that he is not seeking setting aside of the order under revision but would state that his client may be given liberty to seek framing of relevant issues on the subject points raised by him at the time issues are framed by the trial Court.

The civil revision petition is accordingly closed granting liberty to the petitioner as prayed for. Pending miscellaneous petitions, if any, shall also stand closed. There shall be no order as to costs. ______________________ SANJAY KUMAR, J 1st SEPTEMBER, 2017 Svv
