THE HON'BLE SRI JUSTICE T.SUNIL CHOWDARY CRIMINAL PETITION No.13575 of 2015 ORDER:
This petition is filed under Section 482 Cr.P.C. to quash the proceedings against the petitioner/accused in C.C.No.1049 of 2014 on the file of the Court of the X Additional Chief Metropolitan Magistrate at Secunderabad.
The learned counsel for the petitioner seeks permission of this Court to permit the petitioner to withdraw the criminal petition with liberty to avail the remedies available to him under law including filing of a petition for discharge. He further submitted that the presence of the petitioner may be dispensed with before the trial Court taking into consideration his age.
Permission is granted.
There is no dispute with regard to the identity of the petitioner. Even if his presence is dispensed with, no prejudice will be caused to the second respondent.
Hence, the Criminal Petition is dismissed as withdrawn granting liberty as prayed for. The presence of the petitioner, who is the sole accused in C.C.No.1049 of 2014, before the trial Court is hereby dispensed with on each and every date of adjournment. However, he shall appear before the trial Court as and when his presence is so required.
Consequently, Miscellaneous Petitions, if any, pending in this Criminal Petition, shall stand closed.
