HON'BLE SRI JUSTICE M.S.K. JAISWAL Criminal Petition No. 4427 of 2015 Order:

This Criminal Petition is filed, under Section 482 of the Code of Criminal Procedure, 1973, seeking to quash the entire proceedings in Crl.M.P. No.1542 of 2014 in DVC No.13 of 2010 on the file of the Judicial Magistrate of First Class, Medak, including issuance of warrant of arrest. Heard the learned counsel for the petitioner and the learned Additional Public Prosecutor representing the State.

The contention of the petitioner is that though he is complying with the orders passed in MC No.11 of 2010, the respondent in order to put pressure on him filed CrlMP No.1542 of 2014 in DVC No.13 of 2010 and the Court below, contrary to the orders passed in DVC No.13 of 2014, dated 04.08.2010, taken cognizance of the said petition and issued warrant of arrest.

Having regard to the facts and circumstances of the case, the Criminal Petition is disposed of directing the Judicial Magistrate of First Class, Medak, to dispose of Crl.M.P. No.1542 of 2014 in DVC No.13 of 2010 on its own merits as expeditiously as possible, however, the learned Magistrate is directed not to execute the arrest warrant, if any, issued against the petitioner herein. As a sequel thereto, the miscellaneous applications, if any, pending in the Criminal Petition shall stand closed.
