THE HON'BLE SRI JUSTICE M.SATYANARAYANA MURTHY CRIMINAL PETITION NO.4599 OF 2018 ORDER:

This criminal petition is filed under Section 482 Cr.P.C to quash the proceedings against the petitioners in C.C.No.164 of 2018 before the Additional Junior Civil Judge, Mangalagiri, Guntur District.

During hearing, learned counsel for the petitioners requested this Court to dispense with the appearance of the second petitioner/A-2, enabling the first petitioner/A-1 to represent A-2 and appear before the Court.

But, such permission cannot be granted, unless there is an application filed under Section 37 of Criminal Rules of Practice. Hence, the petitioners are permitted to file an application under Section 37 of Criminal Rules of Practice or an application under Section 205 Cr.P.C to dispense with the appearance of the first petitioner and to represent A-2 and appear before the Court on behalf of her. Further, on filing such application, the Magistrate is directed to dispose of the said application within one week. With the above observation, criminal petition is disposed of, without touching the merits of the case.

Consequently, miscellaneous applications pending if any, shall stand closed. No costs.
