This Criminal Petition is filed under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short, 'BNSS') by the petitioner-accused No.11, seeking bail in Crime No.30 of 2025 of Prohibition and Excise Station, Dhoolpet, Hyderabad, registered for the offences punishable under Section 8(c) r/w 20 (b)(ii)(C) of Narcotic Drugs and Psychotropic Substances Act, (Amendment Act, 2001) (for short "NDPS Act,1985"). 2.

Heard learned counsel for the petitioner and Mr.V.Jithender Rao, learned Assistant Public Prosecutor appearing for the respondent-State. Perused the record. 3.

The allegations leveled against the petitioner herein is that she is doing Ganja business with co-accused and frequently purchases Ganja from accused No.1 and used to sell it to needy customers and earning easy money illegally.

4. Learned counsel for the petitioner submits that the petitioner herein has nothing to do with the offence alleged against her and that no drug was seized from the

possession of the petitioner. Hence, he prays to grant bail to the petitioner.

5. On the other hand, learned Assistant Public Prosecutor submits that no Ganja has been seized from the possession of the petitioner and it is only on the confession of accused No.1, the petitioner was charged for the said offences.

Having regard to the submissions made by the learned counsel for the parties and considering the fact that no Ganja has been seized from the possession of the petitioner and she being shown as purchaser and she has been in judicial custody since 13.04.2025 and she is a pregnant lady and to that effect reports are placed before this Court, this Court is of the opinion that the petitioner can be enlarged on bail, subject to the following conditions: (i) The petitioner-accused No.11 shall be released on bail on her executing a personal bond for a sum of Rs.25,000/-(Rupees Twenty Five Thousand only) with two sureties for a like sum each to the satisfaction of the I Additional Chief Judicial Magistrate, at Hyderabad.

(ii) After release, the petitioner-accused No.11 shall appear before the concerned S.H.O. at 11.00 a.m. on first and third Sunday of every month for a period of

eight (8) weeks or till filing of the charge sheet, whichever is earlier, for the purpose of investigation, and thereafter, as and when required.

(iii) After release, if the petitioner-accused No.11 indulges in any offence, the respondent-State is entitled to file an application seeking cancellation of the bail granted by this Court in her favour. (iv) The petitioner-accused No.11 shall abide by the other conditions stipulated in Section 480(3) of BNSS and shall co-operate with the investigation. 7.
