This Criminal Petition is filed under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for short, 'BNSS') by the petitioner-accused No.15, seeking bail in Crime No.30 of 2025 of Prohibition and Excise Station, Dhoolpet, Hyderabad, registered for the offences punishable under Section 8(c) r/w 20 (b)(ii)(C) of Narcotic Drugs and Psychotropic Substances Act, (Amendment Act, 2001) (for short "NDPS Act,1985"). 2.

Heard learned counsel for the petitioner and Mr.V.Jithender Rao, learned Assistant Public Prosecutor appearing for the respondent-State. Perused the record. 3.

The allegations against the petitioner herein are that the petitioner purchased ganja from accused No.1, and as such, the petitioner is charged for the offences punishable under Section 8(c) r/w 20(b)(ii)(C) of the NDPS Act, 1985. 4.

Learned counsel for the petitioner submits that the petitioner herein has nothing to do with the offence,

and that no drug was seized from the possession of the petitioner.

On the other hand, learned Assistant Public Prosecutor submits that no ganja has been seized from the possession of the petitioner, and it is only at the instance of the confession of accused No.1 that the petitioner was charged for the said offences.

Considering the fact that no ganja has been seized from the possession of the petitioner, and he is shown as a purchaser and has been in judicial custody since 16.04.2025, this Court is of the opinion that the petitioner can be enlarged on bail, subject to the following conditions: (i) The petitioner-accused No.15 shall be released on bail on her executing a personal bond for a sum of Rs.25,000/-(Rupees Twenty Five Thousand only) with two sureties for a like sum each to the satisfaction of the I Additional Chief Judicial Magistrate, at Hyderabad.

(ii) After release, the petitioner-accused shall appear before the concerned S.H.O. in between 11.00 a.m. to 2.00 p.m. on first and third Sunday of every month for a period of eight (8) weeks or till filing of the charge sheet, whichever is earlier, for the purpose of investigation, and thereafter, as and when required.

(iii) After release, if the petitioner-accused No.15 indulges in any offence, the respondent-State is entitled to file an application seeking cancellation of the bail granted by this Court in her favour. (iv) The petitioner-accused No.15 shall abide by the other conditions stipulated in Section 480(3) of BNSS and shall co-operate with the investigation. 7.
