HON'BLE SRI JUSTICE ABHINAND KUMAR SHAVILI WRIT PETITION No.15906 of 2019 ORDER:

This writ petition is disposed of at the stage of admission with the consent of both the parties.

This writ petition is filed seeking the following relief :- " ...... to issue order or direction more particularly one in the Writ of Mandamus directing the respondents to consider and dispose the petitioner's representations dated 19.6.2019 and 8.7.2019 taking into consideration the final judgment in W.P.No.31447 of 2014, dt.10.2.2015 and revise petitioner's pensionery benefits thereafter by fixing a time limit ......" .

Heard Mr.K.R.Srinivas, learned counsel for petitioner and the learned Government Pleader for Forests.

It has been contended by the petitioner that he is a retired Forest Beat Officer and while he was working, the respondents have imposed punishment of stoppage of 14 increments with cumulative effect without having effect on his pension on various dates commencing from 14.10.1991 to 09.03.1992. He further submits that he made representations to the respondents on 19.06.2019 and 08.07.2019 requesting to consider his case by taking into account the judgment rendered by this Court in W.P.No.31447 of 2014 dated 10.02.2015, but, so far, the respondents have not passed any orders on the said representations nor considered his case. Learned counsel for the petitioner submits that appropriate orders be passed in the writ petition directing the respondents to consider the representations submitted by the petitioner on

19.06.2019 and 08.07.2019 and pass appropriate orders in accordance with law.

The learned Government Pleader appearing for the respondents has contended that the case of the petitioner will be considered and appropriate orders would be passed on the representations submitted by the petitioner in accordance with law. This Court, having considered the rival submissions, is of the considered view that this writ petition can be disposed of directing the respondents to consider the representations submitted by the petitioner on 19.06.2019 and 08.07.2019 duly taking into account the judgment rendered by this Court in W.P.No.31447 of 2014 dated 10.02.2015, if not already considered, and pass appropriate orders in accordance with law within a period of eight weeks from the date of receipt of a copy of this order.

With the above observations, the writ petition is disposed of. No order as to costs.
