Learned counsel for the petitioner submits in similar circumstances, this Court disposed of WP.Nos 4838 and 16583 of 2011 by its order dated 17-06-2015. The same is not disputed by learned Assistant Government Pleader for Panchayat Raj. But however states that escalation of 5% and other amounts have already been paid and the counter affidavit filed by the 3rd respondent also reveals the same.

In view of the same, following the order dated 17-06-2015 in WP.Nos 4838 and 16583 of 2011, this writ petition is allowed with a direction to the respondents to allow the escalation prices of cement, steel and bitumen on the entire component of such escalation. However, as contended by learned Assistant Government Pleader the amount already paid to the petitioner on account of escalation shall be given credit to while paying balance amount on account of escalation. As a sequel to the disposal of this petition, miscellaneous petitions, if any, pending shall stand closed.
