ORDER:

The temporary injunction granted in favour of the respondent, plaintiff in O.S. No.29 of 2014, on the file of the Junior Civil Judge, Gajuwaka, was questioned by the petitioner - sole defendant in the suit, in C.M.A. No.3 of 2016 in the Court of the XIII Additional District Judge, Gajuwaka. The grievance of the petitioner in this revision petition is that though the appeal was filed in March, 2016 neither I.A. No.288 of 2016 filed in C.M.A. No.3 of 2016. nor the C.M.A. itself is being disposed of by the lower appellate Court. Having regard to the innocuous grievance of the petitioner, without expressing any opinion on the merits of the case, the civil revision petition is disposed of with a direction to the XIII Additional District Judge, Gajuwaka, to dispose of the C.M.A. itself expeditiously.
