THE HON'BLE SRI JUSTICE C.V. NAGARJUNA REDDY AND THE HON'BLE MS. JUSTICE J. UMA DEVI WP NO. 17566 of 2017 ORDER: (Per Hon'ble Sri Justice C.V. Nagarjuna Reddy) This writ petition is filed for issue of habeas corpus directing respondents 1 to 5 to produce the alleged detenue Saidupalli Suchimitha d/o Saidupalli Tirupathi Reddy, aged 27 years, before this Court and set her at liberty.

Police personnel of respondent No.5 produced the alleged detenue before this Court.

At the hearing, the alleged detenue informed the Court that as the petitioner threatened to commit suicide, she succumbed to his pressure and married him in Arya Samaj, Balkampet and she never lived with him after marriage. She further submitted that she is living with her brother and parents as she did prior to the marriage and that she has no inclination to join the petitioner. In the light of the views expressed by the alleged detenue, as noted above, we are convinced that she was not forcibly taken away by her parents and that she has been voluntarily living with them. Hence the relief claimed in this writ petition cannot be granted. This order, however, does not preclude the petitioner from availing appropriate legal remedies for enforcement of his matrimonial rights against his wife.
