HON'BLE SRI JUSTICE S.V. BHATT W.P.No.27836 OF 2011 ORDER:

The petitioner prays for a direction to respondents not to dispossess the petitioner from Sy.Nos.90/ 10 and 90/ 11, Block-6, Door No.6-18 of Rayavaram Village and Mandal, East Godavari District without recourse to law.

The counsel appearing for parties submit that notice dated 01.10.2011 was issued calling upon the petitioner to remove the encroachment. On 14.10.2011, the petitioner claims to have submitted explanation. Hence, the issue is pending for consideration by respondent No.4. Since a notice was already issued, it is submitted by learned counsel that enquiry can be directed to be completed by respondent No.4 within reasonable time, afford opportunity to petitioner and pass orders and till such time, the demolition or dispossession shall not be undertaken. The prayer is limited and since a notice by petitioner was already issued, I am satisfied the writ petition can be disposed of by this order:

The interim order granted by this Court on 11.10.2011 is directed to be continued for a period of four months from today. The Tahsildar/ respondent No.4 is directed to complete the enquiry initiated through notice dated 01.10.2011 and pass orders within three months from today.

The writ petition is, accordingly, disposed of. There shall no order as to costs.

Consequently, pending miscellaneous petitions, if any, stand closed.
