THE HON'BLE SRI JUSTICE CHALLA KODANDA RAM Writ Petition No.9519 of 2015 ORDER:

In this writ petition the petitioners challenge the proceedings No.B/1242/2011, dated 30-01-2014 issued by the Tahsildar, Maheshwaram Mandal, Ranga Reddy District, under the A.P. Rights in Land and Pattadar Pass Books Act, 1971 (for short 'the Act').

Learned counsel for the petitioners submits that the order of the Tahsildar dated 30-01-2014 makes a reference to the proceedings of the Collector, wherein he issued a clarification to the proceedings of the Revenue Divisional Officer, dated 1101-2010, in view of the orders of the Joint Collector dated 06-01-2011 in File No.F1/657/2010.

Further, it is stated that the order impugned is not served upon the petitioners, and that they obtained a true copy of the same from the Deputy Tahsildar's office, Maheswaram Mandal.

The learned Government Pleader for Revenue submits that against the order passed by the Mandal Revenue Officer, there is an effective alternative remedy of appeal to the Revenue Divisional Officer, under Section 5-B of the Act. In the light of the respective submissions, since there is an alternative remedy available to the petitioners, this Court is not inclined to entertain the writ petition. However, considering the facts and circumstances of the case, the petitioners are

directed to file appeal before the Revenue Divisional Officer within a period of two weeks from today, and the same shall be taken on file, and be dealt with in accordance with law.

The writ petition is accordingly disposed of. The miscellaneous petition filed in the writ petition shall also stand disposed of. There shall be no order as to costs.
